The Hot Springs County Board of Commissioners met in regular session on Tuesday, October 7, 2014 at 9:00 a.m. in the Commissioners Room at the Government Annex.

Present were Commissioners Mike Baker, Brad Basse and John Lumley. Also present were County Clerk Nina Webber, County Attorney Jerry Williams and Administrative Assistant to the Commissioners Penny Herdt. Chairman Baker led those present in the Pledge of Allegiance.

Approval of Agenda
Brad Basse made a motion to approve the agenda as presented. John Lumley seconded the motion. Motion carried.

Approval of Minutes
John Lumley made a motion to approve the minutes of the regular meetings on September 2, 16 and 22, 2014 as presented. Brad Basse seconded the motion. Motion carried.

Maintenance Monthly Report
Maintenance Foreman Chuck Carver provided a rough estimate for repairs to the roof of the museum prepared by Dave Kauffman of Roofing Solutions, Inc. out of Montana. Mr. Kauffman has proposed to do an audit to establish the project requirements, and handle the preparation and issuance of the request for bid proposals for an estimated cost of $3,500.00 - $4,000.00. Brad Basse moved to authorize Chuck Carver to secure the services of Mr. Kauffman for the contract and bidding phases for the repair of the museum roof for an amount not to exceed $4,000.00, with funds to come from the Capital Projects- Museum Roof Replacement line item. John Lumley seconded the motion. Discussion: any additional funds required for the roof repair project will be requested through Consensus Grant project funds. Motion carried.
Mr. Carver notified the Commissioners that he has been informed that pricing for the elevator maintenance contract will increase 3.35% this year — an unbudgeted increase of roughly $100.00 annually.
Mr. Carver reported that TRANE representatives came to work through the final issues with the WYECIP project last week. He feels that TRANE has now done all that can be expected of them to resolve the ongoing issues with the project and recommended that the Commissioners sign the Certificate of Final Completion when it is received and release the final payment.
Regarding the front doors to the Courthouse, Mr. Carver reported that he has identified an online source that will allow custom design of new doors that would be similar in style and appearance to the current doors, but with much greater safety and efficiency ratings. He is continuing work on this project.
Mr. Carver will be gone on vacation October 15-25th .

Road & Bridge Monthly Report
R&B Supervisor Dave Schlager reported that the fall blading is mostly complete. Road & Bridge has done extensive grader and pothole patching on Black Mountain Road in preparation for winter and has used a large portion of the stockpiled cold mix. The equipment has been winterized. A washout along the canal on East River Road required some guardrail replacement which is now complete. Mr. Schlager notified the Commissioners that Road & Bridge personnel have started their winter schedule of working eight hour days, five days a week. He reminded the Commissioners of the RAMP work session to be held on October 21st from 2-4 p.m. at the Annex.
Mr. Schlager presented the Commissioners with a purchase order for the new grader. Honnen Equipment requires a signed purchase order before they will order the equipment. As the purchase of the grader was approved at the last regular Commission meeting, Chairman Baker signed the purchase order for submission to Honnen Equipment.
Clerk Webber presented paperwork for the Commissioners to fill out as required by the bank for their Customer Identification Program. After reviewing the paperwork, Brad Basse moved to approve

Resolution 2014-06 authorizing the Chairman to sign municipal lease agreements as the County representative as follows:
RESOLUTION 2014-06
AUTHORIZING THE CHAIRMAN’S SIGNATURE ON MUNICIPAL LEASES
WHEREAS, the County of Hot Springs desires to purchase Capital Equipment using the Municipal Lease form of financing to avoid binding of future Commissioners to other forms of purchase financing, and
WHEREAS, the Commissioners desire to designate the Board Chairman as the County’s representative/signor on the Municipal Lease document as authorized under State Statute,
THEREFORE, the Hot Springs County Board of Commissioners hereby resolves that the Chairman of the Board of Commissioners is authorized to act as the signor for all municipal leases entered into by Hot Springs County.

John Lumley seconded the motion. Discussion: The intent of this resolution is to authorize the Chairman’s signature on any and all municipal leases entered into by the County, including the lease with Bank of Thermopolis for the new grader currently under discussion. Motion carried.

South Thermopolis Water & Sewer District Project Utility Licenses Agreement Variance
Heath Overfield presented the Commissioners with a variance request for an open cut on Lane 7 as part of the STWSD Expansion Project. The variance requested is to open-cut Lane 7 at the intersection of County Roads #33, #34, and #34E, as the existing utilities and culverts under the County Road prevent the initially proposed alignment to be followed. Road & Bridge Supervisor Schlager has recommended the variance request for approval with four conditions of approval, which Mr. Overfield agreed to meet. After reviewing the plan and conditions, Brad Basse moved approval of South Thermopolis Water & Sewer District’s Expansion Project Utility License Agreement variance request for an open cut at the intersection of Lanes 7 (CR #33) and 12 (#34), subject to the following conditions:
  1. The culverts under Lane 7 and the Simons driveway will be replaced to Hot Springs County specifications.
  2. The pipe under Lane 7 will be cased to within the required limits of the County Road #33 right-of-way line (or extension thereof).
  3. The trench through Lane 7 will be backfilled with one-sack cement treated backfill.
  4. A twelve (12) foot (minimum) patch will be machine-paved across Lane 7 to minimize the rough transition of the patch.
John Lumley seconded the motion. Motion carried.

Planner Monthly Report
Planner Bo Bowman distributed copies of the final Natural Resources Plan for State & Federal Lands. th This document is available for viewing on the County website. The NRPC will meet October 8th at 6:00 p.m. Due to the lack of a quorum on October 15 , the Land Use Planning Board has moved the Public Hearing on the Bobcat Storage Subdivision to October 22nd . The Kirby Creek (Hillberry) Subdivision Final Plat is not yet ready for approval. Brad Basse moved to table approval of the Kirby Creek Subdivision Final Plat to the October 21st meeting. John Lumley seconded the motion. Motion carried.

Youth Alternatives Monthly Report
Director Alan Rossler reported there are currently six participants in his program, and one on probation through Circuit Court. There was one 48-hour hold in September. Mr. Rossler presented his quarterly drawdown request for July 1 — September 30, 2014. John Lumley moved to authorize the chairman’s signature on the Drawdown Request for the VOANR/OJJDP 2011 Non-Participating State Award Sub-Grant CFDA #16.540 for the time period of 07/01/14-09/30/14 in the amount of $6,017.13. Brad Basse seconded the motion. Motion carried. Mr. Rossler notified the Commissioners that he plans to resign from his position effective the end of November for family reasons. The County Attorney asked Mr. Rossler to

consider taking a furlough instead of resigning. Mr. Rossler agreed to take this option under consideration and return on the 21st to discuss the possibility.

Tax Rebates / Supplementals
Deputy County Assessor Judy Carswell presented the following rebates to the County Commissioners for approval:
  1. Rebate #6-14 — Parcel #4764 for tax year 2014 (District 100) — AERO PLUS LLC — There was a duplicate assessment for a 1976 Cessna 182Q aircraft, when this parcel should have been the assessment for a 1960 Piper A-22. This resulted in over-assessment of 4204 for tax year 2014 on this parcel and calls for a rebate of taxes in the amount of $265.89. Brad Basse moved to approve Rebate #6-14 to AERO PLUS LLC for parcel #4764 in the amount of $265.89. John Lumley seconded the motion. Motion carried.
  2. Rebate #7-14 — Parcel #3532 for tax year 2014 (District 152) — GPS2 LLC — Real Property and Improvement at 410 South 6th , plus personal property. This rebate is necessary as the personal property of the former owner, Riverbend Sheet Metal, was inadvertently left on this account, resulting in over assessment of 4726 for tax year 2014, and calls for a rebate of taxes in the amount of $322.53. (See supplemental #1 below to Riverbend Sheet Metal in District 101). Brad Basse moved to approve Rebate #7-14 to GPS2 LLC for parcel #3532 in the amount of $322.53. John Lumley seconded the motion. Motion carried.
  3. Rebate #8-14 — Parcel #671 for tax year 2014 (District 109) — Victor Damien and Tanya M Oliver — Lot 45 Sage Valley Subdivision with improvements — This rebate is necessary as the personal property of the former owner, Scott Miller, was inadvertently left on this account, resulting in over assessment of 2271 for tax year 2014, and calls for a rebate of taxes in the amount of $143.63. (See supplemental #2 below to Scott Miller). John Lumley moved to approve Rebate #8-14 to Victor Damien and Tanya M. Oliver for parcel #671 in the amount of $143.63. Brad Basse seconded the motion. Motion carried.
  4. Rebate #9-14 — Parcel #188 for tax year 2014 (District 100) — Travis and Ariel Allen — 145.86 acres with improvements and personal property — This rebate is necessary as the personal property of the former owner, FD and Norma Allen, was inadvertently left on this account, resulting in over assessment of 4690 for tax year 2014, and calls for a rebate of taxes in the amount of $296.62. (See supplemental #3 below to FD and Norma Allen). John Lumley moved to approve Rebate #9-14 to Travis and Ariel Allen for parcel #188 in the amount of $296.62. Brad Basse seconded the motion. Motion carried.
  5. Rebate #10-14 — Parcel #4019 for tax year 2014 (District 152) — Pitney Bowes, Inc. — leased postage equipment — This rebate is necessary as one piece of equipment should have been assessed to Pitney Bowes Global Financial Services LLC, resulting in over assessment on this account of 533 for tax year 2014. This calls for a rebate of taxes in the amount of $4.16. (See supplemental #4 below to Pitney Bowes Global Financial Services LLC). John Lumley moved to approve Rebate #10-14 to Pitney Bowes, Inc. for parcel #4019 in the amount of $4.16. Brad Basse seconded the motion. Motion carried.
  6. Rebate #11-14 — Parcel #828 for tax year 2014 (District 100) — Graves Land and Livestock LLC — 1593.15 acres with improvements and ag personal property — This rebate is necessary as the ag personal property of the former owner, John LeRoux, was inadvertently left on this account, resulting in over assessment of 4359 for tax year 2014, and calls for a rebate of taxes in the amount of $275.69. (See supplemental #5 below to John LeRoux). John Lumley moved to approve Rebate #11-14 to Graves Land & Livestock LLC for parcel #828 in the amount of $275.69. Brad Basse seconded the motion. Motion carried.
  7. Rebate #12-14 — Parcel #2124 for tax year 2014 (District 102) — Willard V & Maycle B Wilson Trusts — 80 acres with improvements and personal property — This rebate is necessary as the personal property of Jason and Billie Jo Norsworthy was inadvertently assessed on this account, resulting in over assessment of 416 for tax year 2014, and calls for a rebate of taxes in the amount of $27.97. (See supplemental #6 below to Jason and Billie Jo Norsworthy). Brad Basse moved to approve Rebate #12-14 to Willard V. and Maycle B. Wilson for parcel #2124 in the amount of $27.97. John Lumley seconded the motion. Motion carried.

  1. Riverbend Sheet Metal — New Parcel #6653 for 2014 (District 101) Personal Property This commercial personal property should have been assessed to Riverbend sheet metal in District 101 for 2014. This results in the need for a supplemental tax notice for tax year 2014 in the amount of $336.71. Corresponds with Rebate #7-14.
  2. Miller, Scott and Kristen — New Parcel #6659 for 2014 (District 109) Personal Property of Scott and Kristen Miller. This commercial personal property should have been assessed to Scott and Kristen Miller in District 109 for 2014. This results in the need for a supplemental tax notice for tax year 2014 in the amount of $143.63. Corresponds with Rebate #8-14.
  3. Allen, FD and Norma — New Parcel #6657 for 2014 — Agricultural personal property of FD and Norman Allen. This ag personal property should have been assessed to FD and Norma Allen in District 100 for 2014. This results in the need for a supplemental tax notice for tax year 2014 in the amount of $296.62.   4. Pitney Bowes Global Financial Services LLC — New Parcel #6658 for 2014 —Personal property. This personal property should have been assessed to Pitney Bowes Global Financial Services LLC in District 150 for 2014. This results in the need for a supplemental tax notice for tax year 2014 in the amount of $4.16. Corresponds with Rebate #10-14.
  5. LeRoux, John - New Parcel #6654 for 2014 — Agricultural personal property of John LeRoux. This ag personal property should have been assessed to John LeRoux in District 100 for 2014. This results in the need for a supplemental tax notice for tax year 2014 in the amount of $275.69. Corresponds with Rebate #11-14.
  6. Norsworthy, Jason and Billie Jo - New Parcel #6662 for 2014 — Agricultural personal property of Jason and Billie Jo Norsworthy. This ag personal property should have been assessed to Jason and Billie Jo Norsworthy in District 102 for 2014. This results in the need for a supplemental tax notice for tax year 2014 in the amount of $27.97. Corresponds with Rebate #12-14.

Well Permit Reviews
Commissioner Lumley reported that he has not received any positive responses to his inquiries to local geologists regarding their willingness to review well permit applications. Several more names were suggested. Commissioner Lumley will continue to work on this and will report back at the next meeting.

Airport Update
FAA AIP-04 Request For Reimbursement #4 — Jeremy Gilb presented FAA Request for Reimbursement #4 for the Commissioners’ approval. John Lumley moved approval of FAA Project 3-56-0043-04 RFR #4 in the amount of $1,994,031.00. Brad Basse seconded the motion. Motion carried.
WYDOT-Aeronautics Division THP-11E-3030 Request for Reimbursement #4 — Mr. Gilb presented WYDOT-Aeronautics Division Request for Reimbursement #4 for the Commissioners’ approval. Brad Basse moved approval of WYDOT-Aeronautics Division Project THP-11E-3030 RFR #4 in the amount of $177,248.00. John Lumley seconded the motion. Motion carried.
Relocation Update —Dustin Spomer reported that Holden Land Company has submitted Claim #2 for relocation expenses. This claim does not include vet bills, brand inspection fees, utility disconnect/reconnect fees and stationery replacement costs, so there will be at least one more claim. Mr. Spomer asked the Commissioners to approve an extension of the final submission date to October 31, 2014. Brad Basse moved to extend the time period for submission of receipts for relocation expenses to October 31, 2014. John Lumley seconded the motion. Motion carried. Regarding the Displaced Persons issue, Charlie Holden has been contacted and interviewed and is preparing to submit his receipts on a claim for expenses. Jamie Bardell has been contacted by phone message and letter, but has not yet responded. No final submission date has been established at this time for claims from either of the Displaced Persons. Another letter will be sent via registered mail to Mr. Bardell requesting his response and containing time limit information.
WYDOT-Aeronautics Division THP-11B-2794 Request for Reimbursement #19 — Mr. Gilb presented WYDOT-Aeronautics Division Request for Reimbursement #19 for the Commissioners’ approval. John Lumley moved approval of WYDOT-Aeronautics Division Project THP-11B-2794 RFR #19 in the amount of $183,302.00. Brad Basse seconded the motion. Motion carried. Due to the size of the RFR document,

it will be scanned and submitted to WYDOT by GDA. GDA will provide an FTP link to the signed document for retrieval by the County Clerk.
TCT West Utility Easement — Mr. Gilb presented a Right-of-Way easement between Hot Springs County and Tri-County Telephone Association, Inc. (TCT West) for placement of the phone and data lines at the new airport site for the Commissioners’ consideration. Brad Basse moved to approve the Right-of-Way easement from Hot Springs County to Tri-County Telephone Association, Inc. (TCT West) for placement of the phone and data lines at the new airport site per Exhibit A as attached to the easement agreement. John Lumley seconded the motion. Motion carried.
Construction Update — Phase III is currently 82% complete. Phase IV is currently 41% complete. Mr. Gilb expects the paving portion of the projects to be completed by October 24th , weather permitting. Both phases are currently under budget, with any excess funds to be applied to Phase V projects going forward.

Emergency Management Monthly Report
Emergency Management Coordinator Bill Gordon reported that he had a very good turnout of County employees at the Emergency Situation Response trainings he conducted on October 1st . Mr. Gordon requested and received authorization to have the local propane dealer top off the tank at the Wyo-Link tower before the weather makes it difficult to do so.

Other Business
Fair Building Floor — Chairman Baker reviewed the results of the inspection of the Fair Building Floor damage conducted by Roy Mathis with Concrete Stabilization Technologies. The Commissioners agreed that the floor needs to be replaced in its entirety rather than adopting a “piecemeal” repair approach. This project will be considered during the Consensus Funds discussion later this week.
WYECIP Project Review — TRANE was on-site last week working with Mr. Carver to finalize the WYECIP Energy Project. Mr. Carver stated that he feels TRANE has completed everything required of them. Chairman Baker expressed his disappointment with TRANE’s work, but agrees that the project is finished as far as he can tell. Chairman Baker will check with TRANE to ascertain when the Certificate of Final Completion will be submitted for signature.
Owl Creek Water District CDBG DDR #30 — Clerk Webber presented CDBG Grant Draft Request #30 for the Owl Creek Water District’s expansion project for the Commissioners’ consideration. Brad Basse moved to approve the Wyoming Business Council Investment Ready Communities CDBG Grant Draft Request #30 for the Owl Creek Water District Water Supply project in the amount of $1,477.00. John Lumley seconded the motion. Motion carried.
