The Hot Springs County Board of Commissioners met in special session on Friday, June 29, 2012, at 12:00 p.m. in the Commissioners' Room at the Government Annex.

Present were Commissioners Brad Basse, John Lumley, and Mike Baker. Also present were County Clerk Hans Odde and Administrative Assistant to the Commissioners Penny Herdt.

Chairman Brad Basse led those present in the Pledge of Allegiance.

Approval of Agenda
John Lumley moved to approve the agenda with the following changes:
SWITCH:Items 1 (Budget Amendments) and 2 (Consider Fiscal Year End Bills)
ADD:Other Business5. Airport FAA RFR #7
6. Airport WYDOT RFR #7
Mike Baker seconded the motion. Motion carried.

Approve Fiscal Year-End Bills
The following bills were submitted for approval: (see attached). Payroll for June was $162,442.21.

Public Hearing – Budget Amendments
Chairman Brad Basse declared the public hearing for FY 2011-2012 Budget Amendments open at 12:45 p.m. Clerk Hans Odde reviewed the required budget amendments resulting from over- expenditure in some areas. All amendment amounts will come from the Unencumbered Funds item in the budget. There were no mid-year grants received, so there was no Unanticipated Revenue. The total amount of budget amendments required is $130,365.00. After three calls for public comment, receiving none, Chairman Basse declared the hearing closed at 12:53 p.m. Mike Baker moved to approve the FY 2011-2012 Budget Amendments as presented. John Lumley seconded the motion. Motion carried. A copy of the detailed budget amendments is available for public viewing in the County Clerk's office.

Approve Line Item Transfers
County Clerk Hans Odde presented the final year-end budget line item transfers for approval. He noted that all items were intra-budget transfers for the fiscal year ending June 30, 2012. Total amount of line item transfers was $63,715.00. John Lumley moved to approve all line items transfers as presented by Clerk Odde. Mike Baker seconded the motion. Motion carried. A copy of the line item transfers is available for public review in the Clerk's Office.

FY 2012-2013 Budget Discussion
Clerk Odde presented the latest projected revenue figures for the 2012-2013 Budget . Due to uncertainty regarding the annual PILT payment, it is necessary to reduce the proposed budget by roughly $760,000.00 If the PILT payment is approved at the federal level, it will be received in June, 2013, and the amount received will be used as a “real number” in the FY 2013-2014 budget. Clerk Odde asked the Commissioners to review the proposed budget to determine where the necessary adjustments should be made.
After a thorough review, several line items were adjusted to bring the proposed budget into balance. The final public budget hearing will be held on Monday, July 16th at 12:00 p.m.

Resolution 2012-05 – Fire Restrictions
Per the request of HSC Fire Warden Jay Duvall in his letter dated June 27, 2012, the Commissioners discussed the implementation of fire restrictions within the county. John Lumley moved to approve Resolution #2012-05 – Establishing Fire Restrictions for Hot Springs County as follows:
RESOLUTION #2012-05
ESTABLISHING FIRE RESTRICTIONS FOR HOT SPRINGS COUNTY
WHEREAS, based upon recommendations of the Hot Springs County Fire Warden, the Board of Hot Springs County Commissioners are empowered by WYOMING STATE STATUTE 35-9-301 through 35-9-304 to close areas to fire when fire danger in the County is extreme because of drought, the presence of any excessive amount of flammable material or for any other sufficient reason; and
WHEREAS, the Board of Hot Springs County Commissioners find there is an extreme danger of fire throughout Hot Springs County because of drought conditions and there is a presence of excessive amounts of flammable materials and the fire danger is aggravated by open burning and the use of incendiary devices:
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF HOT SPRINGS COUNTY COMMISSIONERS:
1. Effective June 29, 2012 – Until further notice of this Board, any open fire or discharge of any class A, B, and/or C fireworks is prohibited on all unimproved State and Private Land including, but not limited to, all land owners in Hot Springs County or in which HOT SPRINGS COUNTY holds or owns an interest, including county roads, easements and rights-of-way in Hot Springs County. The prohibition is subject to the following exceptions:
A.   Trash or refuse burned between the hours of 6:00 P.M. and 8:00 A.M. inside containers equipped with spark arrestors which are located within a cleared area that has at least a TEN (10) foot radius, and comply with all other laws and requirements.
B.   Camp Fires contained within an established fire ring at an established campground provided the fire is in compliance with BLM, FOREST SERVICE, and NATIONAL PARK SERVICE regulations in effect at the time.
C.   Charcoal fires within enclosed grills.
D.   Use of acetylene cutting torches or electric arc welders provided the torches or welders are used within a cleared area with at least a TEN (10) foot radius
E.   Propane or open fire branding activities provided the branding activities are conducted within a cleared area with at least a TEN (10) foot radius.
F.   Use of chain saws provided the chain saws have spark arrestors properly installed and functioning.
G.   Federal, State or Local Fire or Law Enforcement Officers participating in Fire, Emergency and Law Enforcement Activities.
H.   Public-sponsored fireworks displays which are coordinated with the Hot Springs County Fire Warden or his designee.
2. Unimproved land is defined to mean cropland, agricultural land and undeveloped land which predominately remains in it s natural forested or range condition.
3. The County Fire Warden shall promptly notify the Hot Springs County Board of Commissioners of any changes in the severity of the fire danger.

BE IT FURTHER RESOLVED, that penalties specified in W.S.S. 35-9-304 may be imposed for violations of this resolution, i.e. a fine not to exceed ONE HUNDRED dollars ($100.00) or imprisonment not to exceed thirty (30) days or both, to which may be added cost of restitution.
BE IT FURTHER RESOLVED, that the Hot Springs County Fire Warden shall notify the Wyoming State Forester of the limitations provided for by this resolution, as

well as any and all Commissioners' Rules and Regulations and shall assist in the public notification by posting the order and circulating it to all local media.

Mike Baker moved to approve the Wyoming Business Council Investment Ready Communities Grant Draft Request #4 for the STWSD Expansion project in the amount of $2,226.00. John Lumley seconded the motion. Motion carried.
Owl Creek Water Project CDBG Grant Draft Request # 8 – Clerk Odde presented Grant Draft Request # 8 for the Owl Creek Water project. John Lumley moved to approve the Wyoming Business Council Investment Ready Communities Grant Draft Request # 8 for the Owl Creek Water District project in the amount of $2,464.00. Mike Baker seconded the motion. Motion carried.
Lane 3 Improvement Project IRP Grant Draft Request #21 – Clerk Odde presented the IRP Grant Draft Request #21 for the Lane 3 project. Mike Baker moved to approve Grant Draft Request #21 to WYDOT for the Lane 3, Phase 1 & 2, IRP #CN15020 in the amount of $1,715.25. John Lumley seconded the motion. Motion carried.
Lane 3 Improvement Project SLIB Grant Draft Request #21 – Clerk Odde presented SLIB Grant Draft Request #21 for the Lane 3 project. John Lumley moved to approve Grant Draft Request #21 for SLIB Grant #MRG-11008HS in the amount of $1,898.42. Mike Baker seconded the motion. Motion carried. Commissioner Baker reported that dirt work on the Lane 3 project has been temporarily suspended until the phone and cable utilities can be accurately mapped. Engineering Associates representatives will report further on this issue at the July 3rd Commissioners meeting.
FAA Request for Reimbursement # 7 – AIP #02 – Clerk Odde presented FAA Request for Reimbursement # 7 for the Commissioners' approval. John Lumley moved to approve FAA Project 3-56-0043-02 RFR # 7 in the amount of $66,969.00. Mike Baker seconded the motion. Motion carried.
WYDOT - Aeronautics Division Request for Reimbursement # 7 – AIP #02 – Clerk Odde presented WYDOT-Aeronautics Division Request for Reimbursement # 7 for the Commissioners' approval. John Lumley moved to approve WYDOT-Aeronautics Division Project THP-11A-2807/FAA #3-56-0043-02 RFR # 7 in the amount of $2,114.00. Mike Baker seconded the motion. Motion carried.

There being no further business to come before the Commissioners at this time, Chairman Brad declared the meeting adjourned at 2:15 p.m.
