| The Hot Springs County Board of Commissioners met in regular session on Tuesday, March 6, 2012 at 9:00 a.m. in the Commissioners Room at the Courthouse. Present were Commissioners Brad W. Basse, John P. Lumley and Mike Baker. Also present was County Clerk, Hans Odde and Hot Springs County and Prosecuting Attorney, Jerry D. Williams. Chairman Brad W. Basse led those present in the Pledge of Allegiance. Approve Agenda
John P. Lumley made a motion to approve the agenda with the addition of #5 under other business BLM

Mike Baker made a motion to approve the minutes of the February 7, 2012 and February 21, 2012
meetings. John P. Lumley seconded. Motion carried.Approve Bills
The following billed were submitted for approval: (see attached). Payroll for February, 2012 -
$156,580.31Emergency Management Monthly Report
The emergency management report will be deferred until the second meeting of the month due to the
unavailability of Coordinator, Bill Gordon.Maintenance Monthly Report
Maintenance supervisor Chuck Carver presented for the Commission's consideration a service
agreement from Kone, who performs maintenance on the courthouse elevators. Mr. Carver reported that
when the repairmen from Kone were here last they noted the elevator control board needs to be replaced.
This service agreement will cover the control board replacement and installation. John P. Lumley made
motion to approve agreement for $728.00. Mike Baker seconded. Motion carried.Mr. Carver noted that he needed to shut down several of the heat pumps in the court room due to the noise from not being able to properly bleed them, thinks he might be able adjust pressure the alleviate the problem. He also reported that the county surplus items sale is almost ready; there are some large items that will be sold through sealed bids. The power outage last week didn't cause too many problems and what fuses did blowout have now been replaced. Road & Bridge Monthly Report
Road & Bridge Supervisor Ray Shaffer reported he hired Smith Oilfield Service to strip the county pit on
Web road for a future crushing project.DEQ will be updating their rules and Mr. Shaffer is sending Dave Schlager to a seminar in Buffalo to get further information. Mr. Shaffer stated that his crew is trying to finish rural section of Lane 3 before the weather gets worse. An approach agreement and payment for Theron and Sarah Cox at 451 Rim Rock was reviewed by Mr. Shaffer and presented to the Commissioners for their consideration. Mike Baker made a motion to approve the approach agreement as presented. John P. Lumley seconded. Motion carried. R&B continues to work on road naming and numbering throughout the county. Mr. Shaffer reported that the WYDOT bridge inspectors inspected the county bridges and all are good in good shape except the Gooseberry Bridge. The inspectors agreed that we can do some banding on the pilings and re-deck the bridge so it will pass further inspections in the near future. Mr. Shaffer has been approached by the State Parks and Recreation Commission to designate the Grass Creek Road as a recreational road so that unlicensed vehicles can travel freely to the forest lands at the end of the road. The Commissioners agreed they need time for more information to come forward. 1 The R&B crew will be blading roads and renting a track hoe to do some work on the grass creek road as weather permits. Youth Alternatives Monthly Report
Director, Alan Rossler gave his monthly report and noted his census numbers are still up.Mr. Rossler noted that Sheriff Deputy, Cameron Simeral has been working with a young man who has gone to the Youth Challenge program at Camp Guernsey and the young man is now on track to get his GED and may possibly commit to a career in the military, yet another example of Youth Alternatives and law enforcement working together to find positive solutions. County Planner Bo Bowman reported that there would be two items on the Land Use Planning Board
agenda for this month, the Hensley land use change and another small platting issue.Mr. Bowman has received a letter from a telecommunications company who wants to place a 155 foot tower two miles north of Kirby, Mr. Bowman will keep the Commissioners apprised if this issue progresses further. The NRPC has completed their workshops on state and federal lands and now Mr. Bowman will bring their work together into one document. Mr. Bowman would like to place an ad in the Independent Record to remind the County's citizens that certain permits are needed in the county for new construction and or change of use. The Commissioners agreed that this would be a good idea. Sable Run Plat Amendment - Final
Planner Bowman presented the amended Sable Run plat for the Chairman's signature; formal action had
been taken at the previous Commissioners meeting. No action was necessary other than the Chairman's
required signature.Lane 3 Update
Heath Overfield of Engineering Associates discussed with the Commissioners a letter from WYDOT
District 5 Engineer Shelby Carlson regarding costs incurred on the Lane 3 project that may not be eligible
for reimbursement by the IRP Grant. Mr. Overfield stated that he and his Cody office are working closely
with Ms. Carlson to resolve the issues in a manner suitable to both parties.Mr. Overfield also updated the Commissioners on the recent bid opening for the Lane 3 project and noted that Dave's Asphalt was the apparent low bidder. The bid tabulation will now be turned over to the WYDOT Dist. 5 office for their review and approval at the March 15eh WYDOT Commission meeting, upon their concurrence the County Commissioners will then make the final award. Commissioners – Discussion – Holland and Hart
The Commissioners discussed their ongoing relationship with tribal gaming lawyers, Holland and Hart.
Mike Baker noted that the County may be in a position to discontinue their use at the end of March as
there are only three action items left for Tom Sansonetti and Maryt Fredrickson (Holland and Hart
lawyers) to cover.1. Set a date to meet with the Governor and his staff regarding the potential for Gaming in Hot Springs County. 2. Tom Sansonetti will be meeting with the Office of Indian Gaming in Washington D.C. later this month. 3. Reply to a letter received from the Arapahoe Tribe regarding the potential for gaming in Hot Springs County. Weed & Pest Special Mill Request
Acting Supervisor, Marvin Andreen and Secretary, Shawna Farrell approached the County
Commissioners with the annual request an additional 1 mill on the Counties assessed valuation for the
special management areas for weeds and mosquitoes. Mr. Andreen reported that these funds are being
used to match grant funds for removal of russian olive trees, white top treatment and mosquito
abatement. John P. Lumley made a motion to approve the assessment of the additional one mill for the
special management areas for weeds and mosquitoes. Mike Baker seconded. Motion carried.2 GDA Airport Update
County Clerk, Hans Odde presented the FAA Airport Relocation RFR # 2 in the amount of $18,833. John
P. Lumley made a motion to approve the FAA Airport Relocation RFR # 2 in the amount of $18,833. Mike
Baker seconded. Motion carried.John P. Lumley made a motion to approve the WYDOT Airport Relocation RFR # 2 in the amount of $595.00. Mike Baker seconded. Motion carried. GDA had no further update and asked that the Commissioners enter into executive session. Executive Session – Land Acquisition

As a result of discussions held during executive session Mike Baker made a motion to accept Joe
Holden's counter offer for purchase of the property for the proposed new airport. John P. Lumley
seconded. Discussion took place that the deal shall be completed on Friday March 9, 2012 in a special
meeting of the County Commissioners. Motion carriedMike Baker made a motion to delay any further legal proceedings until after Friday, March 9, 2012 in order to give Mr. Holden the opportunity to consummate Memorandum of Agreement with Hot Springs County. John P. Lumley seconded. Motion carried. The Commission will meet at 3:00 p.m. on Friday the 9th with Mr. Holden to sign the MOA for the proposed new airport property. Trane Feasibility Study Presentation
Kim Ketchum with Trane explained that her company had been in the County buildings in February and
studied where exactly the county could save energy and therefore money and use the savings to pay for
the energy efficiency upgrade projects.Ms. Ketchum specifically pointed out a lighting replacement project and a retrofit to the heat pumps in the courthouse would both be projects that would be in order and save long term costs. Owl Creek Water Dist. CDBG DDR#4John P. Lumley made a motion to approve the Owl Creek Water District draw down request #4 to the Wyoming Business Council in the amount of $5580. Mike Baker seconded. Motion carried. Utility License Agreement – Pacific Power- Lane 12 Mike Baker made a motion to approve Utility License Agreement for Pacific Power on Lane 12 for an overhead power line to cross County Road Lane 12. John P Lumley seconded. Motion carried. DEQ letter of Credit #002 John P Lumley made a motion to sign the annual DEQ letter of credit #2. Mike Baker seconded. Motion carried. Appoint Hospital Board Member
Present Hospital Board member, Brian Green introduced Robin Roling who is the new Hospital
administrator.There were three applicants for the Hospital Board; LeRoy Hayes, Health Overfield and Howard Willson. After the Commissioners cast their ballots Clerk Odde reported that Heath Overfield received a unanimous vote. Mike Baker made a motion to appoint Heath Overfield to the Hospital Board and draft letters of thanks to the other candidates for their willingness to serve our community. John P. Lumley seconded.
