| The Hot Springs County Board of Commissioners met in regular session on Tuesday, May 3, 2011 at
9:00 a.m. in the Commissioners Room at the Government Annex Present were Commissioners John P. Lumley, Brad Basse and Mike Baker. Also present were County Clerk Hans Odde, and Administrative Assistant to the Commissioners Penny Herdt. Chairman John P. Lumley led those present in the Pledge of Allegiance. Approval of Agenda Mike Baker made a motion to approve the agenda with the following additions: ADD: Regular Business10. Consider Smith #3 Well Permit Application Other Business7. Shoshone Forest Law Enforcement Annual Agreement Executive SessionPersonnel Brad Basse seconded the motion. Motion carried. Approval of Minutes Brad Basse made a motion to approve the minutes of April 5 and April 19, 2011 as presented. Mike Baker seconded the motion. Motion carried. Approve Bills The following bills were submitted for approval: (see attached). Payroll for April, 2011 - $150,769.26. Emergency Management Monthly Report Emergency Management Coordinator Bill Gordon reported that RT Connect had removed the obsolete E911 equipment from the generator room to increase the usable space in that area. Mr. Gordon asked the Commissioners for permission to dispose of the old equipment as there does not appear to be any salvage value to it. The Commissioners gave their approval for Mr. Gordon to work with Maintenance Supervisor Chuck Carver to dispose of the old equipment. Maintenance Monthly Report Maintenance Supervisor Chuck Carver reported that the rooftop unit replacement project at the Museum is underway and should be finished by the end of the month. A large pipe broke in the squad room and has been repaired. Work proceeds on the grounds. The lawns have been fertilized, the trees treated for borers and the sprinkler system is nearly ready for the season. Road and Bridge Monthly Report Road & Bridge Superintendent Ray Shaffer reported that a bid has been accepted for crushing 15,000 tons of Gradation W from the Ready Pit. Pit inspections by the WYDEQ are anticipated to occur this month. The deadline for application for road improvement funds under the Energy Impacted Roads program is approaching. The original amount of $50,000,000.00 in total available funds statewide has been cut to $6,000,000.00 and after doing some investigation of the requirements, Mr. Shaffer feels that more time and money would be spent applying for the grant than would be received via a grant at this time. The Commissioners agreed with Mr. Shaffer but asked that he study and identify which county roads would be most appropriate for assistance if the County were to decide to apply for one of these grants in the future. Two new cattle guards and a new 36" culvert have been installed on Skelton Road. The demolition of the Curtin building is complete and work on the new county parking area is nearly finished. The Road and Bridge department will return to assist Maintenance Foreman Carver in placing the parking blocks in that area in the near future. The rented hammer equipment is currently out of commission. The rental company has promised to replace the machine and credit will be given for the days the equipment is out of service. Repairs have been made to the old shop roof. Mr. Shaffer reported that the "Walk & Roll" equipment demonstrated for the Commissioners last month has been acquired on a lease-purchase agreement. 1 Tonn Approach Agreement — Mr. Shaffer presented an application from Terry Tonn, Sr. for an approach on Jones Road (County Road 28). Mr. Shaffer has reviewed this application and recommends it for approval. Mike Baker moved to approve Mr. Tonn's approach application for Jones Road. Brad Basse seconded the motion. Motion carried. Fire Number Discussion — Mr. Shaffer reported that he has discussed the visibility issue resulting from the WYDOT District Five supervisor's mandate that all fire numbers on state highways be moved out of the right-of-ways and placed on the fences with representatives from Road & Bridge departments around the state as well as other WYDOT officials. There does not seem to be a good solution to this problem at this time. Larger numbers on larger signs are being considered, but that will be fairly costly. Address Update Issues — As part of the larger Road Policy Revision project, Road & Bridge employees have been reviewing the county fire number system for the past several months. Mr. Shaffer has drafted a resolution to establish a formal, written numbering system for the Commissioners' consideration after review by the County Attorney. The current system was loosely established about thirty years ago and has resulted in many inconsistencies and confusion for emergency responders in rural areas of the county. The intent of the Road & Bridge department and the Commissioners was to begin the process of fire number revision with public meetings to discuss the various aspects of the project and gather public input. However, within the last few weeks, letters appear to have been sent out by the County Assessor's Office, which is responsible for upkeep of the Rural Fire Numbering Book, informing county residents of changes in their addresses without the benefit of those public meetings. Notification of the address changes have also been sent to the Post Office. As a result, the Commissioners, Road & Bridge department, and the County Clerk have all received numerous calls from the affected residents expressing concern about the process. Citizens Dale and Sue Jackson and Penny Herdt were present and expressed their concern and questioned how soon these changes were actually going to happen. Mr. Shaffer and the Commissioners agreed that there should be at least one public meeting for feedback and input before any final decision on a formal fire numbering system revision was made. Chairman Lumley will contact the Post Office to determine if the address changes can be reversed in their system. When he receives that information, a date will be established for a public meeting to allow information to be disseminated and input received from interested/affected county residents before any further Fire Number Policy decisions are made and/or implemented. Youth Alternatives Monthly Report Youth Alternatives Director Bob Wyss discussed Governor Mead's call for a statewide emphasis on diversion programs for dealing with troubled youth. At this point, 98% of Mr. Wyss's Youth Alternatives participants are on a diversion program, so he feels that Hot Springs County is ahead of the game in that area. Mr. Wyss reminded that Commissioners that he is retiring at the end of May and offered to help his replacement in any way needed. Director Wyss presented the new VOA grant application for the Commissioners' approval and signature. The amount requested has increased this year to cover extra hours needed for paperwork and a cell phone for the new director. Mr. Wyss has used his personal cell phone during his tenure, but thought there should be funding in case the new director does not wish to use his personal phone. Brad Basse moved approval and signature of the chairman on the VOA-OJJDP Non-Participating State Grant Application in the amount of $28,660.00 covering the time period 10/01/2011-09/30/2012. Mike Baker seconded the motion. Motion carried. As a final note, Director Wyss encouraged the Commissioners to make sure the new director completes the True Thought program training as quickly as possible, as it has been a very good resource for the program. Appoint Weed & Pest Board Member — Area 1 Clerk Odde presented the application received from Wyatt Agar for the open position in Area 1 on the Weed & Pest Board. All the signatures have been verified and the application is complete. Mike Baker moved to appoint Wyatt Agar to the Weed & Pest Board as the Area 1 representative. Brad Basse seconded the motion. Motion carried. 2 Finalize Aggregate Crushing Project Award Clerk Odde explained that the advertisement for bid for the Aggregate Crushing Project had only stated that the bids would be opened and read aloud on May 25th , so the bid award needed to be made during an open meeting. Chairman Lumley reminded everyone that he has recused himself from involvement with this process as he works for R&C Trucks-Crude Oil Hauling, whose owners have a separate gravel business. Bids for the project were as follows: B&B Aggregate - $93,400.00, Oftedal Construction, Casper - $80,640.00, and McGarvin-Moberly - $202,000. Brad Basse moved to accept the bid for the aggregate crushing project at the Ready Pit from Oftedal Construction in the amount of $80,640.00. Mike Baker seconded the motion. Motion carried. Lane 3 Update Engineering Associates representative Ian Sporkin-Morrison presented the Commissioners with an updated plan set for the Lane 3 project, which incorporates WYDOT-required information. Most of the easements are complete — all of them must be in hand before WYDOT will give the go ahead for bidding and commencement of construction. Commissioner Baker reported that the alternate access which had been anticipated during the project was not going to be available, so the rural section (Phase III) would need to be completed prior to any closures for construction of the urban section. Road & Bridge Supervisor Shaffer has indicated that this would be possible in his schedule. Ryan Brothers representatives indicated that this would be acceptable for their business needs. Mr. Morrison reported that the drainage issues have been resolved without the need to cross the highway with the drainage pipe. Bid Procedures & Construction Contract Documents — Clerk Odde presented the Bid Procedures & Construction Contract Documents for the Commissioners' signature. The County Attorney has reviewed the documents and returned them with minor changes. Brad Basse moved to accept Engineering Associates' recommendations for General Conditions, Supplementary Conditions, Instructions to Bidders, Bid Bond, Construction Performance Bond and Construction Payment Bond and, with consultations with insurance providers by the County, complete the Owner's Instructions to Engineers concerning bonds and insurance for construction. Mike Baker seconded the motion. Motion carried. Ryan Brothers Trucking representatives asked about the timeline for receiving payment for the easement they have granted to the County. After discussion with Mr. Morrison, the Commissioners requested the Clerk to process a voucher for payment to Ryan Brothers at this time. Consider Central Bank & Trust Application — Public Fund Depository Clerk Odde presented a Public Funds Depository Resolution from Central Bank & Trust for the Treasurer for the Commissioners' approval. Brad Basse moved to approve Central Bank & Trust's application to serve as a public funds depository for the Hot Springs County Treasurer. Mike Baker seconded the motion. Motion carried. Consider Deputy Coroner Position Chairman Lumley reviewed a lunch meeting with former County Coroner Clark Mortimore in which Mr. Mortimore asked that the Commissioners act to appoint Mike Mortimore as Deputy Coroner to avoid violation of the State Statutes concerning nepotism by the County Coroner. After discussion, the three Commissioners concurred that it was not the place of the Commission to appoint the deputy to any elected official, including the Coroner, and declined to do so. Consider Smith No. 3 Well Permit Application Clerk Odde presented an application from Dave and Carol Smith for a well permit in the Red Lane area for the Commissioners' consideration. This application has been reviewed by the County's geological consultant and recommended for approval. Mike Baker moved to approve the Smith No. 3 Well Permit Application from Dave and Carol Smith. Brad Basse seconded the motion. Motion carried. Other Business Lane 3 IRP Grant Draft Request #10 — Clerk Odde presented IRP Grant Draft Request #10 for the Lane 3 project. Mike Baker moved to approve Grant Draft Request #10 for Lane 3, Phase 1 & 2, IRP # CN15020 project in the amount of $3,437.55. Brad Basse seconded the motion. Motion carried. 3 Lane 3 SLIB Grant Draft Request #8 — Clerk Odde presented SLIB Grant Draft Request #8 for the Lane 3 project. Brad Basse moved to approve Draft Request #8 for SLIB Grant #MRG-11008HS in the amount of $2,612.54. Mike Baker seconded the motion. Motion carried. Airport Snow Removal Equipment RFR #2 — Clerk Odde presented WYDOT-Aeronautics Division Request for Reimbursement #2 for the Snow Removal Equipment project for the Commissioners' approval. Mike Baker moved to approve WYDOT-Aeronautics Division Project THP-13X-2785 RFR #2 in the amount of $2,940.00. Brad Basse seconded the motion. Motion carried. Airport Relocation Project FAA Request for Reimbursement #7 — Clerk Odde presented FAA Request for Reimbursement #7 for the Commissioners' approval. Brad Basse moved to approve FAA Project 3-56-0032-03 RFR #7 in the amount of $86,160.00. Mike Baker seconded the motion. Motion carried. Airport Relocation Project WYDOT - Aeronautics Division Request for Reimbursement #7 — Clerk Odde presented WYDOT-Aeronautics Division Request for Reimbursement #6 for the Commissioners' approval. Mike Baker moved to approve WYDOT-Aeronautics Division Project THP-11A-2757 RFR #7 in the amount of $2,720.00. Brad Basse seconded the motion. Motion carried. Courthouse Communications Upgrade Grant Draft Request #6 — Clerk Odde presented SLIB Grant Draft Request #6 for the Courthouse Communications Upgrade for the Commissioners' approval. Brad Basse moved to approve the Courthouse Communications Upgrade Grant Draft Request #6 to the State Land & Investments Board in the amount of $472.50. Mike Baker seconded the motion. Motion carried. Shoshone Forest Service Law Enforcement Agreement - Clerk Odde presented the Annual Agreement between the US Forest Service and the Hot Springs County Sheriff's Department for law enforcement services in the Shoshone National Forest for the period April 1, 2011 through March 31, 2012 for the Commissioners' approval. Mike Baker moved to approve the Cooperative Law Enforcement Annual Operating Plan & Financial Plan between the Hot Springs County Sheriff's Department and the USDA Forest Service, Shoshone National Forest for FY 2011-2012 — Total Reimbursement Amount not to exceed $4,000.00. Brad Basse seconded the motion. Motion carried. Correspondence Library Board MinutesThe Commissioners reviewed the foregoing items. No further action was required or taken at this time. Executive Session Brad Basse moved to enter Executive Session for reasons of personnel discussion at 12:15 p.m. Mike Baker seconded the motion. Motion carried. Present for the Executive Session were John P. Lumley, Brad Basse, Mike Baker, Hans Odde, Penny Herdt and Planner candidate Bo Bowman. Brad Basse moved to exit Executive Session at 12:30 p.m. Mike Baker seconded the motion. Motion carried. No action was taken during the Executive Session. Planner Hire Mike Baker moved to hire Bo Bowman as the Hot Springs County Planner at an annual salary of $41,000.00 with a start date of May 5, 2011. Brad Basse seconded the motion. Motion carried.
