| The Hot Springs County Board of Commissioners met in special session Tuesday, October 26, 2010, at 8:00 a.m. in the Meeting Room at the Government Annex. Present were Commissioners John P. Lumley, Brad Basse and Mike Baker. Also present was County Clerk Hans Odde. Chairman John P. Lumley led those present in the Pledge of Allegiance. Brad Basse moved to approve the agenda as presented. Mike Baker seconded the motion for reasons of discussion. Intense discussion ensued between the Commissioners regarding the appropriateness of the agenda item and a proposed amendment to the agenda to allow for citizen participation at this particular meeting. Commissioner Baker said he had a phone conversation yesterday with Tom Jubin, private counsel to the County Commission, who advised against this. Chairman Lumley also said he agreed that there would be no testimony nor would he allow it after also visiting with Tom Jubin via phone yesterday. Chairman Lumley did argue that there was a need for the public to have a venue to address their concerns and it was the Commissioners' responsibility under statute for public safety and if the public did not feel they could approach the sheriff or county attorney, they needed to be able to go somewhere with their concern(s). Commissioners Basse and Baker felt that amending the agenda to allow citizen participation when the only advertised agenda item was an Executive Session was inappropriate and potentially unfair. Chairman Lumley disagreed and favored amending the agenda to allow for citizen participation. Commissioners Basse and Baker both agreed the public needed to be able to discuss their concerns and asked that it be placed on the agenda for the November 2nd meeting so there was enough notice given. Commissioner Baker called for the question. Motion to approve the agenda failed by a 0-2 vote. Chairman Lumley asked if there was further business to come before the Board. There being no further business to come before the Board at this time, Mike Baker moved to adjourn the meeting at 8:20 a.m. Brad Basse seconded the motion. Motion carried. | ||
