| The Hot Springs County Board of Commissioners met in regular session on Tuesday, October 7, 2008, at 9:00 a.m. in the Commissioners Room at the Courthouse. Present were Commissioners Brad W. Basse, John P. Lumley and Frank T. Manning. Also present was County Clerk Hans Odde, Hot Springs County and Prosecuting Attorney Jerry D. Williams, and Administrative Assistant to the Commissioners Penny Herdt. Chairman Brad W. Basse led those present in the Pledge of Allegiance. | ||

| Jerry Williams – Equipment Request | ||
| County & Prosecuting Attorney Jerry Williams appeared before the Commissioners to request approval to purchase a projector and screen for use during jury trials for presentations in the courtroom. After discussion, Frank T. Manning moved to approve the purchase of a projector and screen in the approximate amount of $686.00, with the money to come from the Courthouse Equipment Budget. John P. Lumley seconded the motion. Motion carried. | ||
| Planning Monthly Report | ||
| County Planner Lee Campbell reported on the meeting that he and other members of the Shoshone Cooperating Agency Coalition (SCAC) attended in Cheyenne on 10/31/08.with representatives from various state agencies. The purpose of the meeting was to make sure that the SCAC and the state agencies are headed in the same direction with their comments on the various federal land management plans currently under revision. Mr. Campbell felt that the meeting was highly productive and is confident
that the two groups are on the same page. Commissioners gave their approval to a meeting with U.S. Forest Service representatives Becky Aus and Marty Sharp, state representatives, and the commissioners to reaffirm the county’s position regarding the roadless rule in the Gooseberry / Cottonwood Vegetation Management Plan. Mr. Campbell will set up a mutually agreeable date and obtain a time on the agenda for said meeting. Planner Campbell presented the Commissioners with the completed surveys from the Community Assessment process pertaining to county planning issues for their review. | ||
| Youth Alternatives Monthly Report and Draw Down Request | ||
| Youth Alternatives Director Bob Wyss reported that he currently has 11 participants in the
program, with 2 expected to graduate in the next couple of weeks. Mr. Wyss stated that he and High 1
School Counselor Carol Lynch would be attending a session of Family Court held in Basin this week to observe the process, as the Family Court program may expand to Thermopolis in the future. Mr. Wyss then presented Draw Down Request #16 for the current WCCA/OJJDP Grant. John P. Lumley moved to approve DDR #16 in the amount of $921.87 for the WCCA/OJJDP “Non-Participating” State Grant #2006-JF-FX-K002. Frank T. Manning seconded the motion. Motion carried. | ||
| Don McCumber – Owl Creek Water District Map Approval & Update | ||
| Don McCumber presented the Commissioners with an updated map for the Owl Creek Water District for their approval. At the District’s October meeting, those users not wanting to be part of the District were removed from the map. Upon the Commissioners’ approval, the updated map will be submitted to the State Department of Revenue. A discussion ensued regarding individual landowners entering the District at a later date, along with the legal requirements and financial considerations involved in that process. Frank T. Manning made a motion to approve the revised map dated 10/29/2008. John P. Lumley seconded the motion. Motion carried. | ||
| HSC/Thermopolis Economic Development Corporation Monthly Report | ||
| Red Rock Business Park - HSC/Thermopolis EDC Director Lorraine Quarberg presented Commissioners with Draw Down Request #19 in the amount of $184,032.00. The County’s share is $11,288.00.This will be the final Draw Down Request involving matching funds from the County, as the amount set aside for the project by the County has now been reached. Further matching funds will come from the Economic Development Council. This month’s EDC share is $4,714.00. Chairman Basse recused himself from discussion and voting due to his status as a subcontractor on this project. John P.
Lumley moved to approve Draw Down Request #19 in the amount of $184,032.00. Frank T. Manning seconded the motion. Motion carried. Vice-Chairman Lumley will sign the Draw Down Request due to Chairman Basse’s recusal. Ms. Quarberg informed the Commissioners that the EDC had received approval to use $60,000.00 of the unexpended grant funds for the South Thermopolis Water & Sewer District sewer pump expansion project. Business Ready Committed Grant (BRCG) – Vast Manufacturing – Director Quarberg asked that a public hearing for the BRCG application for Vast Manufacturing be set for the regular Commissioners Meeting on 12/02/08. Frank T. Manning moved to set the Public Hearing for the BRC Grant Application for 10:00 a.m. on 12/02/08 in the Commissioners’ Room. John P. Lumley seconded the motion. Motion carried. | ||
| Lou Falgoust – MDT Update | ||
| Sheriff Lou Falgoust presented the Commissioners with letters of support for the Bighorn Basin Mobile Data Project from Washakie County and Bighorn County. He also presented minutes showing support of the project from the town councils of Thermopolis, Worland, Basin and Greybull. Powell has expressed verbal support for the project, but has yet to put anything in writing. Park County remains noncommittal at this time. After discussion, John P. Lumley made a motion to move forward with the grant application, with the caveat that letters of support from all counties and towns involved are to be presented at the Commissioners’ meeting on 12/02/08. Frank T. Manning seconded the motion. Motion carried. Sheriff Falgoust then presented letters in support of the project addressed to Wyoming’s Congressional Delegation for the Commissioners’ signature. Copies of these letters will be submitted with the grant application | ||

| Lane 3 Feasibility Study Draw Down Request #1 – County Clerk Hans Odde presented Draw Down Request #1 for the Lane 3 Feasibility Study in the amount of $4132.00. John P. Lumley moved to approve Draw Down Request #1 for the Lane 3 Feasibility Study in the amount of $4132.00. Frank T. Manning seconded the motion. Motion carried. SLIB Draw Down Request #2 - Public Health /Government Annex Project - County Clerk Hans Odde presented Grant Draw Down Request #2 for the Public Health/Governmental Annex Project in the amount of $8840.32. John P. Lumley moved to approve Draw Down Request #2 in the amount of $8840.32. Frank T. Manning seconded the motion. Chairman Brad W. Basse abstained from the vote due to his 2
intention to bid on parts of the project. Motion carried. Vice-Chairman John P. Lumley signed the Draw Down Request due to Chairman Basse’s abstension. Clerk Odde reported on the Asbestos Abatement progress. Bids are due to the Clerk’s Office on 11/10/08, and will be opened, reviewed and the contract awarded at a Special Meeting of the Commissioners on 11/14/08. Construction Manager At Risk Groathouse Construction will be invited to the 11/18/08 Commissioners meeting for introductions and the opportunity to establish an open line of communication for the project. Plan1 Architects is still waiting on the digital portion of the Site Survey, but should have it shortly. The Commissioners commended Clerk Odde on all the extra effort he has put into getting this project off the ground. TCT Culvert Cut – Clerk Odde reported that TCT West had cut one of the culverts in the county, and is working with the Road & Bridge Department to repair the damage at TCT’s expense. Sheep #1 Well Permit – Clerk Odde presented Sheep #1 Well Permit from Jack and Ellen Baird to the Commissioners for review. He noted that Hurley Geological has reviewed the permit and recommended it for approval. Frank T. Manning moved to approve the Sheep Well #1 Permit. John P. Lumley seconded the motion. Motion carried. Upcoming Meetings – Lane 3 Feasibility Study Public Meeting to be held 11/06/08 at 7:00 p.m. at City Hall; Airport Study Input Committee Meeting to be held 11/10/08 at 6:30 p.m. in the Big Horn Federal meeting room – Chairman Basse asked Clerk Odde to ensure that all members of the SIC have a copy of the Final Draft/Master Plan Report for review; Special Commissioners’ Meeting regarding Asbestos Abatement Bid Opening/Award to be held 11/14/08 at 9:00 a.m. in the Commissioners’ Room – Clerk Odde will request the presence of Terracon representative Bob Brownell to assist in evaluation of the bids. BHB Resource Management Plan – Commissioner Lumley presented an Issue Rating Survey for the BLM RMP with the request that it be filled out and returned to Greg Kennett at Ecosystems Research Group (ERG) by November 13, 2008. Commissioner Lumley also reviewed the notes provided by DeLoyd Quarberg from a preliminary scoping meeting held in Worland on 10/31/08 with the BLM, ERG, and county commissioners from the Big Horn Basin counties. Finally, Commissioner Lumley presented a press release prepared by ERG regarding the upcoming public scoping meetings for the Commissioners’ review. | ||
